Hi Paul,

Hope you are ok.
I sent the e-mail on Monday demanding written guarantee if they want to repair my laptop + money I paid for the report and extended.
I also underlined that I would not accept any repairs which could downgrade the specification of my laptop.

In conclusion I wrote that if they are unable to meet these conditions I demand the partial refund + costs of the report and extended warranty.

I gave them time until today saying I would proceed to the Small Claims Court including the cost of the interest and court claim costs.
Haven't heard anything from them.

I used credit card to buy the laptop. Shall I write to them now?

Hello Kris,

Well, if you have had no response from the retailer then you should now contact the card company to make a Section 75 refund claim.

They will probably want to see copies of correspondence that you have had with the retailer plus a copy of your report.

Hopefully they will be a little more obliging than the retailer.

I got a reply from my credit card company, it may take 4 weeks for them to deal with my complaint, I think I need to be patient or should I chase laptopsdirect again?

I would advise that you wait for the card company but it would not harm to also chase Laptops Direct.

Please ensure that you keep copies of any communications that you send as you may need to show them to the card company at a later stage.

Four weeks is a long time though, I think that they need to take on more staff.

I got an email from laptops direct:
"Dear Mr XXX
Apologies for the delayed response.
We have received your laptop and after reviewing the issue you have reported we would like to come to an agreeable resolve.
We would like to offer you a settlement in cash of £277.77. This figure has been calculated in accordance with the sales of goods act which indicates an electrical item should be fit for us for up to 6 years.
£799.98 Value of item when purchased.
(47) months Time of product use.
£277.77 Total Value offered.
As a alternative offer, if you would like to proceed with an alternative product we would be prepared to offer £320.00 part exchange. Can you please let me know how you would like to proceed.
I look forward to your response.
Kind Regards"

There is nothing about refund for an extended warranty or refund for your report.
I am not going to accept this offer. Am I right?

Hello Pokoros,

Their calculation is indeed correct and is in line with what you are entitled to.

However, you are also entitled to a refund of the engineers report as that is a consequential loss and you are entitled to this back.

You are also entitled to a refund of the extended warranty as they cannot charge you for a warranty on an inherently defective laptop.

Did you pay for the warranty direct to Laptops Direct? If so then you should contact them and request a refund of this amount also.

As they were kind enough to show how they have calculated the refund they cannot claim that this amount includes your other losses.

You are nearly there now, just a little more of a push and your claim will be at an end.

Fingers crossed that this step goes smoothly. :x

First BIG THANK YOU, GREAT JOB MAN :! !!! I have gone that far only because of this forum and Lapcure report.
After few e-mails I have decided to accept offer of £342.77 (laptop+report) from Easycomputers (laptopsdirect, buyitdirect, acerdirect etc....). After months of waiting, misleading letters I feel that I am a winner (we are the winners)!!! I know I should have claimed extended warranty costs but I must admit I used that warranty couple of times and the fault transpired 10 months after the extended warranty expired.
To all forum users:
Never give up, if you know your laptop suffers from Nvidia defect the law is on your side.
Easycomputers (laptopsdirect, buyitdirect, acerdirect) did try to fob me off, first "laptop was out of warranty" but when I provided Paul's report they responded that suddenly ACER confirmed that it contains defective graphic chip. In the second letter they wrote to me that the product should be fit "reasonable amount of time" not 6 years and recently I got an email from them stating that the partial refund calculation was "in accordance with the sales of goods act which indicates an electrical item should be fit for us for up to 6 years".
How bad is that? No comments.
Now I am waiting for them to arrange my refund. I have put everything on hold until I see the real money!!!
